The author is analysing international legal aspects of the protection of minorities in Europe. He worked as a Hungarian governmental expert in the Council of Europe inter alia in the committees CAHLR & CAHMIN dealing respectively with the drafting of the texts of the European Charter for Regional or Minority Languages and the Framework-convention for the Protection of National Minorities in Europe but the papers collected in the present volume were prepared in his individual capacity. The book intends to give a comprehensive picture of the difficulties encountered during the preparation and the implementation of international legal instruments and of the strong and weak points of these instruments.
A special attention is paid to the problem of the Nation-state, its functions and effects in the past and in the present from the point of view of the minority issue. How can states harmonize the individual and collective type of minority protection, what is the relationship between minority self-governmental endeavours and positive law? To what extent are multilateral and bilateral treaties complementary to one another? The answer he offers is not only a theoretical but also a pragmatical nature, based on comparative constitutional law and on the interpretation of international legal instruments. Péter Kovács (1959), a member of the Société Française pour le Droit International, is Professor of International Law at the Pázmány Péter Catholic University (Budapest) and the Miskolc University.
